PRIVACY NOTICE REGARDING THE PROTECTION AND PROCESSING OF PERSONAL DATA
Aykos Smart Living Control and Automation Systems takes the highest possible security measures to ensure that your personal data is collected, stored, and shared in compliance with the law and to protect your privacy.
Our goal is to inform you as transparently as possible regarding the methods by which your personal data is collected, the purposes for which it is processed, the parties with whom it is shared, the legal grounds for such processing, and your rights, in accordance with Article 10 of the Personal Data Protection Law No. 6698 and with a view to ensuring your satisfaction.
- Data Controller
In accordance with the Law on the Protection of Personal Data No. 6698 (“Law No. 6698”), your personal data is collected and processed by Aykos Smart Living Control and Automation Systems(“COMPANY”), acting as the data controller, within the scope described below.
- For What Purpose Will Personal Data Be Processed?
The COMPANY collects personal data from its customers, employees, potential customers, job applicants, representatives and employees of government agencies, business partners, and suppliers;
We collect special category personal data and personal data (collectively referred to as “Personal Data”) in the following categories: identification information, contact information, customer information, customer transaction information, health information, performance information, transaction security information, legal proceedings and compliance information, and marketing and sales information.
The personal data we collect;
– To provide you with the Company’s products and services, fulfill our obligations to you, maintain records and documents, and comply with data retention, reporting, disclosure, tax, and other obligations required by local and international laws and regulations,
– To conduct sales and marketing activities aimed at improving the quality of our services and products, and to provide you with personalized advertisements, campaigns, benefits, and advantages as part ofyour “Aykos Smart Living Control and Automation Systems” membership,
– To communicate with you regarding IT requirements, system architecture, the necessity of IT support services, and to provide you with the necessary information about these services and products,
– Conduct traffic measurement, statistical analysis, segmentation/profiling, and CRM activities for sales and marketing initiatives via the website, social media accounts, and mobile app,
– To measure and improve customer satisfaction, manage complaints, gather your feedback and suggestions regarding new services and products, receive your reports of issues and errors, and provide you with information regarding our products and services, as well as your complaints and requests,
– To contact you, process your orders, handle your payments, coordinate logistics with third parties to ensure product delivery, identifying products and services that may interest you and making recommendations accordingly, sending promotions and gifts, analyzing your online behavior to display personalized ads, measuring and improving the quality of the services we provide, and managing our customer portfolio through profiling and scoring based on categories we define,
-For the purpose of using your personal data in connection with comparative product and/or service offers, modeling, existing or new product studies and/or developments, and any products and services to be provided to you under the laws and relevant regulations governing the activities set forth in the COMPANY’s Articles of Association,
– To comply with data retention, reporting, and disclosure obligations prescribed by government agencies; to fulfill the requirements of contracts; and to discharge the legal obligations to which the COMPANY is subject in connection with the use of these services,
– To manage the Company’s financial operations, communications, market research, and corporate social responsibility activities; procurement operations (requests, bids, evaluation, orders, budgeting, and contracts); internal system and application management operations; and legal operations, in line with the objective of determining and implementing the Company’s commercial and business strategies;
– Your personal data is processed for the purpose of reviewing, evaluating, and responding to requests received from official authorities or from you.
- To Whom and for What Purpose Personal Data May Be Disclosed
The personal data we collect is limited to the processing purposes specified in the second section above and applies to all such data;
– The Company’s business partners, shareholders, subsidiaries,
– To persons or entities authorized under the provisions of the Tax Procedure Code, Social Security Institution regulations, the Court of Accounts, the Law on the Prevention of Money Laundering, the Law on the Prevention of Money Laundering, the Turkish Commercial Code, the Code of Obligations, the Law on the Regulation of Electronic Commerce, and other applicable legislation,
– Public institutions and organizations authorized by law, administrative authorities, and judicial authorities,
– To foreign companies and their subsidiaries,
– Your personal data is shared with natural or legal persons from whom we receive services or with whom we collaborate for the purposes of product/service comparison, analysis, evaluation, and advertising, as well as with program partner organizations; with institutions with which we have agreements regarding the delivery of messages sent to our customers; and with shipping companies responsible for delivering your orders to you.
- Method and Legal Basis for the Collection of Personal Data
Your personal data may be processed both by fully or partially automated means and by non-automated methods that form part of a data filing system;
Applications made directly by you or by persons authorized to act on your behalf; through partner websites; by store and COMPANY headquarters staff; by natural and/or legal persons with whom we conduct transactions in accordance with all applicable laws or contracts; and by automated systems (our website and mobile app, call centers, social media accounts) in verbal, written, or electronic formats;
As specified in Articles 5 and 6 of the Law;

- is directly related to the formation or performance of the contract and is necessary for its execution,
- provided that such processing is necessary for the legitimate interests of our Company and does not infringe upon your fundamental rights and freedoms,

It collects based on the legal grounds set forth above.
- The Rights of Data Subjects Under Article 11 of Law No. 6698
As data subjects, if you submit requests regarding your rights using the methods outlined below, the COMPANY will process the request as soon as possible and no later than thirty days, depending on the nature of the request. In this context, data subjects have the right to request the rights listed in Article 11 of the Personal Data Protection Law from the data controller, the COMPANY. You may submit your request regarding the exercise of the rights specified in Article 11 in Turkish and in writing, or via registered electronic mail (KEP) address, a secure electronic signature, a mobile signature, or the email address previously notified to the COMPANY and registered in our system. In such requests, information will be provided solely regarding the applicant; it will not be possible to obtain information regarding other family members or third parties. The COMPANY reserves the right to verify your identity before responding.
In your application;

– For citizens of the Republic of Turkey, your Turkish ID number; if you are a foreign national, your nationality, passport number, or ID number (if available),
– Your residential or business address for service of process,
– If available, your email address, phone number, and fax number,
– Your request must be submitted, and any relevant information and documents must be included with the application.

Depending on the nature of your request, you must provide us with all necessary information and documents that enable us to verify your identity, ensuring they are complete and accurate. If the requested information and documents are not provided as required, there may be delays in the Company’s ability to conduct a thorough and proper investigation regarding your request. In such a case, the COMPANY reserves its legal rights. Therefore, your application must be submitted in a manner that is complete and includes all the required information and documents in accordance with the nature of your request.
